Treating Clients Fairly


Taking matters a step further, we believe in treating clients as well as their data.  It is a core value of our business and is central to the way we work.


We will always :


  • Behave in a fair, honest, open and professional way.
  • Be transparent about our fees.
  • Make sure we have a clear understanding of what you need, and why you need it.
  • Tell you if we think something is not in your best interests, even if it means we lose out on business because you decide not to go ahead.
  • Provide you with a clear written proposal explaining how we work and what we can do for you; plus an engagement letter that sets out clearly the terms of our appointment and the goals we must achieve for you.
  • Explain the pros and cons of each relevant financing option, so that you can make the right decisions for you and your property business.

  • Share with you any proposals before we send them to lenders on your behalf, so that you can check any information pertaining to you, your business and your finance needs.

Who we are

Bespoke Property Finance Consultants Ltd are Property Finance Consultants based in Liverpool. We act as an introducer/advisor/broker/intermediary for our customers. Bespoke Property Finance Consultants Ltd are Directly Authorised and Regulated by the Financial Conduct Authority (FRN 845075).

 

How we will use the information about you

Here at Bespoke Property Finance Consultants Ltd, we take your privacy seriously and will use your personal information in a number of ways which will help us;

1. obtain lender decisions;

2. assist with transaction and financial management;

3. for fraud prevention;

4. for audit;

5. for statistical analysis;

6. credit reference checks.

We may share your information with, and obtain information about you from, credit reference agencies or fraud prevention agencies. If you apply to us for insurance we will pass your details to the insurer.

Information you provided may be put onto a register of claims and shared with other insurers to prevent fraudulent claims.

We will not disclose your information to any company outside of Bespoke Property Finance Consultants Ltd, except to help prevent fraud or if required by law to do so.

Your Personal Data:

 

What we need 

Bespoke Property Finance Consultants Ltd will be what is known as the controller or processor of the personal data you provide to us. We collect personal data about you which may also include any special types of information or location-based information. 


We also gather 

Names, addresses, email addresses, information on marital status and family circumstances (including information about dependents), information regarding your financial status including your income, expenditure, assets and liabilities. 


Why we need it

We need to know your basic personal data in order to provide you with an accurate recommendation for your personal circumstances. We will not collect any personal data from you we do not need in order to provide and oversee this service to you.

For processing of data to be lawful under GDPR, Bespoke Property Finance Consultants Ltd use;

(a) Consent: the individual has given clear consent for you to process their personal data for a specific purpose.

(b) Contract: the processing is necessary for a contract you have with the individual, or because they have asked you to take specific steps before entering into a contract.

(c) Legal obligation: the processing is necessary for you to comply with the law (not including contractual obligations).

(d) Vital interests: the processing is necessary to protect someone’s life.

(e) Public task: the processing is necessary for you to perform a task in the public interest or for your official functions, and the task or function has a clear basis in law.

(f) Legitimate interests: the processing is necessary for your legitimate interests or the legitimate interests of a third party unless there is a good reason to protect the individual’s personal data which overrides those legitimate interests. (This cannot apply if you are a public authority processing data to perform your official tasks).


What we do with it

All the personal data we use is controlled by Bespoke Property Finance Consultants Ltd in the UK, however, for the purposes of IT hosting and maintenance, this information is located on servers within the European Union. No 3rd parties have access to your personal data unless the law allows them to do so.We have a Data Protection Policy in place to oversee the effective and secure processing of your personal data, which can be found on our website.

We will pass your data to lenders in order to provide you with offers of products suitable to meet your customer requirements.

In addition, we will also pass your data to third parties, such as solicitors, accountants, valuers, monitoring surveyors, property agents and other relevant professionals, at our sole discretion, to assist us in meeting your customer requirements.

Your data is stored electronically on our cloud encrypted server. Our server is based in the UK.


How long we keep it

We are required under regulation to keep your basic personal data, such as name, address, contact details, for a minimum of 6 years, after which time it will be destroyed. The information used for marketing will be kept with us until you notify us that you no longer wish to receive this information.


What are your rights?

If at any point you believe retained information is incorrect you can request to see this information and even have it corrected and possibly deleted. Providing you with this information is free of charge, but charges may apply for excessive requests.

If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Protection Officer, who will investigate the matter.

Where relevant, you have the right to withdraw consent at any time and this means that we cannot process your data provided without your consent.

If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law you can complain to the Information Commissioner’s Office (ICO).

Complaints Policy

 

  • Bespoke Property Finance Consultants Ltd agrees to act on behalf of the Client in accordance with the terms of the Code of Practice of the National Association of Commercial Finance Brokers (NACFB) as amended (the code) and a copy of the Code is available on request from the Association or on the NACFB website www.nacfb.org
  • Bespoke Property Finance Consultants Ltd will investigate and deal with any complaints raised by the Client concerning the services provided under this Agreement promptly and reasonably but if Bespoke Property Finance Consultants Ltd are unable to resolve any complaint to the Client’s satisfaction the Code of Practice stipulates the procedures available to the Client including NACFB Mediation.
  • If a Client is unhappy with the Broker’s response to their complaint, and the complainant falls within the regulated activities, they may be able to complain to the Financial Ombudsman Service at:

  • The Ombudsman will be able to confirm whether he can look at the complaint. If the Client is entitled to make a complaint to the Ombudsman, then they are not bound to follow any alternative procedure and can make their complaint to the Ombudsman within the timescales set down by the rules applicable to that scheme, details of which will be provided to the Client by us on request.
